Terms of Service — Bocas Eventos

These Terms of Service ("Terms") govern your use of the Bocas Eventos mobile application (the "App") operated by NordyNord LLC, doing business as Bocas Eventos ("we," "us," or "our"). By using the App, you agree to these Terms.

1. Use of the App

Bocas Eventos is an events discovery platform for Bocas del Toro, Panama. The App allows users to browse events, view business listings, save favorites, and explore a map of local happenings. Certain features require account creation.

You must be at least 13 years old, or the minimum age required in your jurisdiction, to use the App. By creating an account, you represent that you meet this requirement.

2. Accounts

You are responsible for maintaining the security of your account. You agree to provide accurate information and to keep your contact details up to date.

We reserve the right to suspend or terminate accounts that violate these Terms. If we suspend or terminate your account, we will notify you via the email address associated with your account and provide the reason for the action. You may appeal by contacting support@bocaseventos.com within 30 days. Upon account termination, your personal data will be handled in accordance with our Privacy Policy. Content you submitted as a creator may be retained in anonymized form.

3. Creator Content

If you are granted creator access, you may post event listings, business information, and images. You represent that you have the right to share all content you submit and that it does not violate any laws or third-party rights.

We reserve the right to remove any content that violates these Terms, is reported by users, or that we determine to be inappropriate, misleading, or harmful.

By submitting content, you grant us a non-exclusive, royalty-free license to display, distribute, and promote that content within the App, on our website, and through our marketing channels for the purpose of providing and promoting the service.

4. Prohibited Conduct

You agree not to: use the App for any illegal purpose; post false, misleading, or fraudulent event information; harass, abuse, or harm other users; attempt to gain unauthorized access to the App or its systems; use automated tools to scrape or collect data from the App; or interfere with the proper functioning of the App.

5. Reporting and Moderation

Users may report events, businesses, or individuals that violate these Terms. We review reports and may take action including content removal and account suspension. Abuse of the reporting system is itself a violation of these Terms.

6. Intellectual Property

All intellectual property rights in the App, including its design, code, branding, and trademarks, are owned by NordyNord LLC. Nothing in these Terms grants you any rights to our intellectual property except the limited right to use the App as described herein.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee the accuracy, completeness, or timeliness of event listings or business information. Event details are provided by third-party creators and we are not responsible for their accuracy.

8. Limitation of Liability

To the fullest extent permitted by law, Bocas Eventos shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to damages related to attending events listed on the App.

9. Indemnification

You agree to indemnify and hold harmless NordyNord LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App, your violation of these Terms, or any content you submit through the App.

10. Force Majeure

We are not liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, power outages, internet disruptions, government actions, or pandemic-related restrictions.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify you of significant changes within the App.

12. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

Before filing any formal claim, you agree to attempt to resolve the dispute informally by contacting us at support@bocaseventos.com. We will attempt to resolve the dispute within 30 days of receiving your notice.

If the dispute is not resolved informally, any legal proceedings shall be brought exclusively in the state or federal courts located in the State of Texas. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against us.

To the extent that Panamanian consumer protection laws (Ley 45 de 2007) apply to you and cannot be waived, those protections shall remain in effect.

Estos Términos de Servicio ("Términos") rigen su uso de la aplicación móvil Bocas Eventos (la "Aplicación") operada por NordyNord LLC, operando bajo el nombre comercial Bocas Eventos ("nosotros" o "nuestro"). Al usar la Aplicación, usted acepta estos Términos.

1. Uso de la Aplicación

Bocas Eventos es una plataforma de descubrimiento de eventos para Bocas del Toro, Panamá. La Aplicación permite a los usuarios explorar eventos, ver listados de negocios, guardar favoritos y explorar un mapa de actividades locales. Ciertas funciones requieren la creación de una cuenta.

Debe tener al menos 13 años, o la edad mínima requerida en su jurisdicción, para usar la Aplicación. Al crear una cuenta, usted declara que cumple con este requisito.

2. Cuentas

Usted es responsable de mantener la seguridad de su cuenta. Acepta proporcionar información precisa y mantener sus datos de contacto actualizados.

Nos reservamos el derecho de suspender o terminar cuentas que violen estos Términos. Si suspendemos o terminamos su cuenta, le notificaremos a través del correo electrónico asociado a su cuenta e indicaremos el motivo de la acción. Puede apelar contactándonos en support@bocaseventos.com dentro de 30 días. Tras la terminación de la cuenta, sus datos personales se manejarán de acuerdo con nuestra Política de Privacidad. El contenido que haya enviado como creador puede conservarse en forma anónima.

3. Contenido de Creadores

Si se le otorga acceso de creador, puede publicar listados de eventos, información comercial e imágenes. Usted declara que tiene derecho a compartir todo el contenido que envíe y que no viola ninguna ley ni derechos de terceros.

Nos reservamos el derecho de eliminar cualquier contenido que viole estos Términos, que sea reportado por usuarios, o que determinemos como inapropiado, engañoso o perjudicial.

Al enviar contenido, nos otorga una licencia no exclusiva y libre de regalías para mostrar, distribuir y promover ese contenido dentro de la Aplicación, en nuestro sitio web y a través de nuestros canales de marketing con el fin de proporcionar y promover el servicio.

4. Conducta Prohibida

Usted acepta no: usar la Aplicación para ningún propósito ilegal; publicar información de eventos falsa, engañosa o fraudulenta; acosar, abusar o dañar a otros usuarios; intentar obtener acceso no autorizado a la Aplicación o sus sistemas; usar herramientas automatizadas para recopilar datos de la Aplicación; ni interferir con el funcionamiento adecuado de la Aplicación.

5. Reportes y Moderación

Los usuarios pueden reportar eventos, negocios o individuos que violen estos Términos. Revisamos los reportes y podemos tomar acciones que incluyen la eliminación de contenido y la suspensión de cuentas. El abuso del sistema de reportes es en sí mismo una violación de estos Términos.

6. Propiedad Intelectual

Todos los derechos de propiedad intelectual de la Aplicación, incluyendo su diseño, código, marca y marcas registradas, son propiedad de NordyNord LLC. Nada en estos Términos le otorga derechos sobre nuestra propiedad intelectual excepto el derecho limitado de usar la Aplicación como se describe en este documento.

7. Descargo de Garantías

La Aplicación se proporciona "tal cual" y "según disponibilidad" sin garantías de ningún tipo. No garantizamos la precisión, integridad u oportunidad de los listados de eventos o la información comercial. Los detalles de los eventos son proporcionados por creadores externos y no somos responsables de su precisión.

8. Limitación de Responsabilidad

En la máxima medida permitida por la ley, Bocas Eventos no será responsable de ningún daño indirecto, incidental, especial o consecuente que surja de su uso de la Aplicación, incluyendo pero no limitado a daños relacionados con la asistencia a eventos listados en la Aplicación.

9. Indemnización

Usted acepta indemnizar y mantener indemne a NordyNord LLC y sus funcionarios, directores, empleados y agentes de cualquier reclamo, daño, pérdida o gasto (incluyendo honorarios razonables de abogados) que surja de su uso de la Aplicación, su violación de estos Términos, o cualquier contenido que envíe a través de la Aplicación.

10. Fuerza Mayor

No somos responsables de ningún incumplimiento o retraso en el cumplimiento de nuestras obligaciones bajo estos Términos debido a circunstancias fuera de nuestro control razonable, incluyendo pero no limitado a desastres naturales, cortes de energía, interrupciones de internet, acciones gubernamentales o restricciones relacionadas con pandemias.

11. Cambios a los Términos

Podemos actualizar estos Términos de vez en cuando. El uso continuado de la Aplicación después de los cambios constituye la aceptación de los nuevos Términos. Le notificaremos de cambios significativos dentro de la Aplicación.

12. Resolución de Disputas y Ley Aplicable

Estos Términos se rigen por las leyes del Estado de Texas, Estados Unidos, sin consideración a los principios de conflicto de leyes.

Antes de presentar cualquier reclamo formal, usted acepta intentar resolver la disputa de manera informal contactándonos en support@bocaseventos.com. Intentaremos resolver la disputa dentro de 30 días de recibir su notificación.

Si la disputa no se resuelve informalmente, cualquier procedimiento legal deberá presentarse exclusivamente en los tribunales estatales o federales ubicados en el Estado de Texas. Usted acepta renunciar a cualquier derecho a participar en una demanda colectiva o arbitraje colectivo contra nosotros.

En la medida en que las leyes de protección al consumidor de Panamá (Ley 45 de 2007) le sean aplicables y no puedan ser renunciadas, dichas protecciones permanecerán vigentes.
